Farglory Group Should Bear Legal Liabilities For Farglory Taipei Dome Site Safety Maintenance

With the incoming of Typhoon Chan-hom, there are reports that Farglory Group has expressed that due to the work suspension orders by Taipei City Government and lack of manpower, Farglory Group can only perform an “ethical” site inspection and typhoon prevention SOP. To this, the Taipei City Construction Management Office sternly states that the 79 violations of non-compliance with construction plans of the Farglory Taipei Dome Site, including changes in floor opening positions, area sizes, positions of floors and stairs and etc. which belong to the primary structure, are in serious violation of Article 58 of the Building, and hence the Taipei City Department of Urban Development issued a work suspension order on May 20th 2015. Causes of work suspension are attributed to the violations of law by builders, contractors, and supervisors. Article 63 of the Building Act clearly stipulates that construction sites should have suitable measures or equipment in place for safety maintenance, danger prevention and fire prevention. The legal liabilities of site safety maintenance of Farglory Taipei Dome during work suspension should be, without a doubt, belong to the site management (i.e. Farglory Group and Taiwan Obayashi Corporation).With the coming of the typhoon, due to necessities of protecting public safety, the Taipei Department of Urban Development has repeatedly requested on July 7th and June 17th 2015 for Farglory Group to fulfill their responsibilities and remove the temporary fixture plates atop the Dome structure, secure the external vertical walls of the Dome, dismantle the scaffolding of the Hotel and Office Sections and other safety precautions, and to propose a disassembly plan for the authorization of the Department of Urban Development. As of today, no active actions have been observed, demonstrating the negligence attitude of Farglory Group for site safety and public safety.Taipei City Construction Management Director, Chen Huang-Cheng expresses again that public safety shall not be compromised. Farglory Group shall abide by Article 63 of the Building Act and bear full legal liabilities for the maintenance of safety of the construction site and implement a relevant safety maintenance plan for the Farglory Taipei Dome during the typhoon and future construction site safety. The Taipei Construction Management Office will continue to supervise Farglory Group and protect the interests of public safety.
